GDPR and AI Chatbots: Compliance Guide

Everything you need to know to use an AI chatbot on your website while complying with European privacy regulations.

The use of AI-powered chatbots raises important questions regarding personal data protection. The GDPR (EU Regulation 2016/679) fully applies to any chatbot that collects, processes or stores data of European users.

What data does a chatbot collect?

An AI chatbot can collect various types of personal data:

  • Identifying data: name, email, phone (via lead capture forms)
  • Conversation content: questions and information shared by the user
  • Technical data: IP address, browser, device, referrer page
  • Metadata: timestamp, conversation duration, language

The 6 GDPR pillars for chatbots

1. Transparent information

Before starting the conversation, the user must know:

  • Who is the data controller
  • What data is collected and why
  • How long data is retained
  • Who receives the data (e.g., AI providers)

2. Legal basis

For informational conversations, the legal basis can be legitimate interest (Art. 6.1.f). For data collection via lead forms, explicit consent is required (Art. 6.1.a).

3. Data minimization

Only collect data that is strictly necessary. If you don't need a phone number, don't include it in the lead capture form.

4. Right to erasure

5. Data security

Data must be protected with appropriate technical measures:

If the chatbot uses AI provider APIs with servers outside the EU (e.g., OpenAI in the USA), you need to verify that adequate safeguards exist (Standard Contractual Clauses, Data Processing Agreement).
